My RN x-wife and HIPAA, In IL.


Hi All,
I have reason to beleive that my x-wife has accessed my medical records at the hospital where she works. In Jul., 2006 I made a trip to the ER of the hospital where she is employed as an RN and as such has access to ALL patient records. She works in another dept. and would have no viable professional reason to access my records. The divorce was not final at that time but we no longer living together. The following day after my visit to the ER she purchased a life ins. policy on me which I believe she has now let lapse.

My questions are:
Is the hospital required to provide me with a list of employees who have accessed my records and what action could I take to assure that it doesn't happen again?

you have nothing but supposition at this point. And no, the hospital is not obligated to do anything absent an attendant lawsuit or HIPPA complaint and without proof you have nothing to file a complaint against.

Wow, fast response, thanks.

In doing some searching on the web I found a (different) hospital with the following on their website. Am I correct in understanding that disclosure to me of who has viewed my medical records is left to each hospitals internal policys?

From XXX Hospital's FAQ's
"Can I find out who has viewed my XXX Hospital patient record?

Yes. If you have concerns about unauthorized personnel accessing your information, you can make a request to the Privacy Office to view all accesses to your XXX Hospital patient record. The XXX Hospital Privacy Office will provide this information to you in a timely manner and an appointment will be set up to discuss this information with you."

By the way, I can purchase a life insurance policy on you if I wanted. let it go.

LOL, okay, I know anyone can buy a live ins policy on anyone. um so maybe my motivation is a little revenge huh lol.

If she has half a brain (which, since she's a nurse, I hope she does) she knows better then to access your records using her sign in. Information is not as secure as most people would like to believe. In most busy hospital ER's, it's not at all unusual for an employee to stay logged into the system and get distracted by an emergency. When that happens, anybody can walk up to the computer and access all kinds of personal information about patients. Plus, she works there. She could have easily had someone in the er, that would have had good cause to look at you records, access the information for them.
