Can a man who is petitioning for a divorce (when there are no children born in the marriage) ask that the former spouse relinquish his name?

The husband has no right to tell the wife if she has to relinquish the name or keep it.

He can ask her to agree to relinquish the name...but its not HIS name, its HER name and a judge can't make her change it.
