In need of help

What is the name of your state? CA

If I fill for a legal separation is my husband of 23 year liable for my debt if I fill bankruptcy

Since CA is a community property state, then yes, he is liable.

He would not necessarily HAVE to file, but the creditors absolutely could/would go after him for the debt if you discharge it in bankruptcy. Unless of course it was somehow premarital debt, which is not too likely after 23 years of marriage.
