need help asap- i dont know whats going to happen

What is the name of your state? Va

Alright, first of all. Can I shut my wifes cellphone off without an legalities? She has been talking to another man(intimatley), in our home state (im in the military stationed in Norfolk Virgina), for the past month. There are other things that play a factor in all of this, but it was the last straw. I dont see why I should have to pay for her to continue to talk to him. She's telling me it's illegal because she wont be able to talk to anyone. I told her to go get her own cellphone. By the way, I plan on getting a divorce from her, all though she is the one that wants it. Everything is in my name. Bank account, cellphones, cars, ect.? Can I do this without repercussion?

On to bigger and better things. I'm sure we're going to be filing for seperationg here shortley. We have a 15 month old daughter. How is all of this going to work. I've heard from some sea lawyers, that she will have to stay in the state of va for a year until we are officially divorced because we have a child. Is this true, I don't want her to move back home because I wont be able to see my daughter but once ever three months, maybe. Due to my duties.

After divorce, what is going to be the out come? I make more money than her, i can provide better for my daughter. She has her GED, and is working a job making $6.15/hour. She has phsycological issues that she never seeked guidance for. She grew up with abuse as a child (all documented by the state of Delaware), and it still effects her to this day (in a big way). As I said before, she has been talking to another man for a while now. She talks to him every day(30 min- hour), I have the phone bill to prove it, along with a post(to myspace) with hearts in it. He also commented her where she's hugging someone and said "why cant that be me", i have all this documented. I know it doesn't sound like much, but I know there is something there. She talks to him during the day, and if I happen to come home early while she's on the phone she immediately hangs up. She wont tell me what she talked to him about. I know for a fact there is something going on. I also know it's very possible because she cheated on me before marriage (about 2 1/2 years ago, but i forgave her in an attempt to get on with our lives). She's been mentally abusing me for the past 9 months. I've been deemed to have depression by a phsychiatrist. She constantly yelled at me, put me down, and told me how worthless I was. I dont want that effecting my daughter (dont want her to grow up dealing with that all the time because of my wifes issues).

Please help me out. I would appreciate any anwsers to my questions, and any advice you all can give to me. I'd really appreciate it.What is the name of your state?

If the cell phone plan is in your name, you can cancel it.
