Need help with Court Hearing tomorrow


What is the name of your state? CA

I was just wondering if someone could clue me in on what goes on at a Case Management Conference stage in a Divorce because I have a hearing for this tomorrow. I feel real clueless because I dont have an attorney and my wonderful soon to be ex husband does. Any help would be greatly apprecieated.What is the name of your state?

Get an attorney.

Doing it on your own is bad enough. But when one side has an attorney and the other side doesn't, it's a formula for disaster - at least from your side.

I would love to get an attorney but he has been our sole provider of income for the past 9 years and I am finding it difficult getting back into the work force after an absence of 9 years. He only gives me 1000 dollars a month in child support hence I have no money to retain an attorney. I really not sure what to do. We have 3 daughters together and I also have another daughter from a previous relationship but he has raised her as his own since she was only 2.

Many attorneys will give you an initial consultation free to discuss your options. If he is the only breadwinner and you have young children, one very real option is that either he would be paying for the attorney or the attorney's costs would come out of marital assets.

Depending on his income, $1 K per month for 3 kids could be very low or very high, but you won't know that unless you find out what you're going to be entitled to.

Well that all depends on how far along you are, what the issues are, and what you've accomplished so far. I mean really how can we anwser that question? If your husband has an attorney, why wouldn't they try to take advantage of the situation? They might try to get an agreed order out of you that really isn't in your best interests. I can't imagine they would be looking to modify the CS..but it could be some other financial issue they are trying to establish for you or him...like employability, income, insurance, medical expenses...etc etc. If I were you...I wouldn't agree with anything if your not sure about it...I'd request a continuance so I could get the proper representation and hope the judge gives you one. You should have your own attorney!!!

And ask the judge to have the husband pay for the attorney. Depending on the financial circumstances, that's reasonably common.
