No default state

What is the name of your state? Delaware

Me and my husband was married in Indiana. I do not know if that was a no fault state or not. We just recently separated and he moved to another state. The state that we reside in for the last 8 years is a no fault state. Do I file for a divorce in the state I was married in or the state I reside in at the time of my separation?

You would file in the state (DE?) you reside in provided he hasn't already met his current state's residency requirements in which case he could file first.

My response:

Simple. You file your Petition in the state you reside at the time of your separation; i.e., The State where you've been living for the last 8 years.
