What is the name of your state? Delaware
Can anyone tell me if a settlement agreement that is signed and notarized but not done by the lawyer or through the courts is a binding legal document?

If you are talking specifically in regards to a marital agreement, it should not be, but could carry weight. If two parties agreed "in principal" to the seperation of property, debt, etc then you would sign it and it would become an order in the court once the Judge agreed to your decree. Usually the Judge will have you appear to endure you both understand the agreement, and it is in the best interest of the parties and children if there are children.

If you are talking about something outside of an agreement between both parties then it could easily be, if certain criteria where met.
