NY State Seperation Papers - question!


What is the name of your state? New York

Hi, My wife and I seperated in 1991- legally - papers and all, and it was reconized by a lawyer. Okay fine. In 1995 - I moved in back in with her, and we never destroyed the papers.. she still has her copies and I have mine.. we are both under the assumption we are seperated but we're just trying to make it work.

Legally, are we still seperated? I mean, yes we do have our fight and all, but we try to do things together, taxes are filed together and such.. but I don't know.

We never legally had the papers destroyed either. We want to be seperated until we know for sure we can make this work. Since 1995 - i have left and come back a couple times.. by the way..

My guess is that you would have to refile. An attorney cannot recognize legal separation papers, only a judge can. Did you ever have a court date for the legal separation?

yes it was reconized by a judge.. everything was handled the right way, I was just curious as to how long it lasts without a paper of settlement or whatnot being filed.
