Active duty military stationed and married in Oregon. I have been married since 15Feb03 (2 mo.). My spouse, also military and stationed in Washington, admitted yesterday to having an affair since the previous October. She started 5 months before the marriage, and continued after the marriage up to the present.

Question-Due to the short length of the marriage and the fact she was cheating prior to it, without my knowledge, would I be able to annul the marriage, instead of filing for divorce?

Thank you.

I am NOT an attorney.

The grounds for annulment in OR are as follows:

#1 Either party incapable of making a contract
#2 Either party not of legal age
#3 Either party did not have a sufficient understanding of marriage
#4 Marriage obtained by force or fraud.

The short length of the marriage and the infidelity of a spouse are not grounds for annulment.

You will have to seek a divorce.
