What is the name of your state (only U.S. law)? NY
We have no dependents, just our two selves; is it considered abandonment if I leave without a formality? Must I file for a legal separation in order to protect interests? No physical abuse is involved, just disrespect and brush-off. Tired at 65.

You can leave. Depending on how long you have been married, your spouse will be entitled to half your retirement, half the assets and half the debt.
