Painful Pat

What is the name of your state? CA.

My husband and I have been together for 11 years, legally married for 6 yrs. We have a 10 yr old son together. I have a few questions about what I am entitled to. I have been somewhat disabled and not able to work for over a year. I have a vascular insufficiency and not able to stand for too long. I was not able to receive any kind of state disability or other compensation because my husband makes too much money (only under Ca. law). He also owns quite an expensive lot in Lake Havasu that he purchased before he knew me. It is because of that property that I was denied my disability insur. My name is not even on the deed. My attorney said that it didnt matter if I was considered in the deal at all. Now that my husband and I are splitting up, do I have any rights to his property ? Do I have any entitlement for support payments for me ? I am not likely to work again or at least not nearly enough to support myself and child even with child support. I am aware that "fairness" has nothing to do with the law. I think that I should be able to claim partial rights to his property since I was dinged for it by social security and state disability. Also, even though we have been legally married for 6 years, and just living together for the other 5 yrs or so, what are my rights according to California law ? Please help

Realistically...you need an attorney. You are certainly entitled to a share in the value of the property that accrued during your marriage....and certainly you will have the right to apply again for Social Security and state disability without your husband being the same kind of factor if you separate. However you truly need an attorney. You shouldn't try to protect yourself without one.
