husband (Fed employee) and wife get divorce after 15-20 years. She decides later she wants lump sum instead of retirement. husband agrees because wife's lawyer tells him she can get it from OPM. OPM refuses request , now they are threatening with contempt because it didn't work like they planned. he has no money and can't get pension unless he quits or gets fired. at retirement he is only entitled to monthly check. he would not have agreed, if he had to come up with the money. another Fed employee told me agreement is not enforceable because she can still come up at retirement and claim her vested interest and he can't get money back if she doesn't abide by agreement. anybody know the law here.
