petition for divorce

State: Virginia

In 2005, I became separated from my husband. This was not a legal separation, but rather a "mutual" one. We have one child together.

In 2006, my husband filed for divorce. It has yet to be finalized since he has not paid the fees to his lawyer.

Its now 2008 and I'm wondering if Im able to file for a separate petition for divorce? Im totally willing to pay for all the fees associated with it. I just want it finalized. I want to file myself, no lawyers.

Also, Ive heard that I can file for divorce now and file for custody later with a separate petition. True?
