Please answer this question!!!


I am in MARYLAND. My husband had me stop working shortly before the birth of our 2nd child. We have two kids, a 10 month old and a 3 year old. My husband is emotionally and verbally abusive. Since I am not working (HIS DECISION), if I want to file for seperation and then divorce, can he be required to pay my legal fees?? Is this something that I would have to pay upfront and then be reimbursed, or can he be required to pay the legal fees from the get go? Thanks.

My response:

The court may, in fact, order him to pay all or part of your attorney's fees. You may, however, and depending upon the attorney you hire, be required by your contract to pay an initial "Retainer Fee", and then your attorney will file the necessary papers with the court for reimbursement by your husband.
