PLEASE HELP ME. MY HUSBAND FATHERED A CHILD DURING OUR 5 YEAR LEGAL SEPERATION PERIOD. MAY I DIVORCE HIM ON THE GROUNDS OF ADULTERY SINCE WE STILL ARE NOT DIVORCED?AND MAY I FILE FOR PERMANENT ALIMONY ON THESE SAME GROUNDS?:(

I'm not familiar with the divorce laws in North Carolina but -

1) If you wanted to divorce your husband, was five years not enough time? Why now? Sounds like you were willing to remain legally separated forever, had the child with another woman not appeared.

2) What does your husband fathering a child by another woman have to do with any alimony that may be due you?

Looks like your husband has moved on.
Looks like you want vengence.
