Power of attorney

My husband and I are separated. His mother recently passed away and he and his brother are the heirs. My husband is a drug user and has now got into some serious trouble with the law, his brother told me that he was going to have him make him his power of attorney because he can't do anything with the checks, and he told his brother to give his 2 kids money. There mother and me were close and she always told me that she wanted the kids to have certain things, I don't know if the grandmother left the kids anything, no one has told me anything, she was the type of person who would have included her only two grandchildren, but I don't know. I guess my question is can he sign over his power of attorney to his brother? I what should or can I do at this point is anything.
