Please help In desperate need of answer for property question

this is from west virginia. my mother is soon to get divorced and inherited the property we live on from her father. she was married to the present husband in 1982 and inherited this property in 1984. he is starting to make gestures about her losing the home. this property is supposed to be passed from generation to generation. she has worked an equal amount of time with him (semi-truck driving) and has paid at least half of all repairs. the quesiton is can he take this property in the divorce? thank you so much

I can only tell you that in Indiana, any property inherited or received as a gift is seen as being owned solely by the person who received it.

Now, he might technically have a claim to half the increase in its value since she acquired it, but generally the courts like to give things that were inherited or received as a gift to the recipient.

The laws might be different in your state, so you might want to ask an attorney who practices there.
