Hi, I have a question. I might be filing for a divorce sometime soon here in New Mexico, and am wondering if my wife has rights to take my public employees retirement money. I've been married 4+ years, and have been on the same retirement plan for nearing 10 years. My question is, is she entitled to take half in the event of a divorce? Or does she get half when I retire? She is the benificiary on it if I die. I still have about 16 years before I can retire. Please help. Thanks

Look at the papers you signed when you joined the plan and see how it is set up and how you will draw your benefits. I do not believe you can change the benficiary. Call the State Controller and they can help you. If NM is community property state then ex will be entitled to percentage of retirement based on time she was married to you and you were in the plan.
