Question in Lousiana

What is the name of your state? lousiana - My wife is filing papers on me for a divorce - do I have to pay for this filing? also once they are filed does she have to move out immediately? Thanks

No, but in the complaint she may ask the court to charge all costs to you.

Ummm. Maybe and maybe. Depends on a lot of different factors. There is no way that there is enough information in this post to state anything.

Also, she doesn't necessarily have to be the one to move out.

3 more questions

Lousiana.

1. Are there any advantages to filing a divorce first or let the other spouse file first?


2. If I get a second job before or after the filing can that be used as additional income in figuring out the percentage of child support?

3. After separating are both parties free and clear to see other people?

No. The woman always has the advantage.

Depends.

If he owned the house they live in before the marriage, and it was a short term marriage, it is very likely SHE will be the one to move.

If he owned it F&C before the marriage, she will probably be the one to move.

If they are in the other half of a two-family owned by his family members, it is likely she will be the one to move.

If he was a long term tenant and she moved in and is not on the lease at all, she will probably need to move, as the landlord only has agreed to rent to him and he is liable for the rental.

If he is a CP already raising his kids in that home, and she later moved in when they married, she will likely be the one ordered to move.

I know all of that....that is why I said "doesn't necessarily" rather than "doesn't"
