I live in Arizona and my husband and I have filed for divorce. I am keeping the house and refinancing it myself. Both the mortgage and title companies tell me I can close previous to the divorce being final but my spouse thinks he will be responsible for the house even though his name will not be on the mortgage or the property. The title company is asking for a letter of permission from him allowing me to refinance before the divoprce is final and he won't do it because of his fears. Can this transaction be completed prior to the divorce being finalized?
