Ruining credit


What is the name of your state? Virginia.
My ex-husband and I have jointly owned property which according to the property settlement agreement he is suppose to maintain. He is not making the mortgage payments on time and ruining my credit. I have not signed a "quick claim deed" and want my fair share of the equity in the house and my name removed from the mortgage and title. What can I do?

The only thing you can do is take it back to court....You are probably going to need to get the judge to order that the house be sold. If your credit is messed up so is his...so its not very likely that he can refinance to get you off the mortgage.

Additional Information


There is a new development in this case, I received a faxed copy of a Quit Claim Deed yesterday that I supposidly signed in October 2002. It was filed with the court but the mortgage was not refinanced until July 2005. I have never seen this document before and suspect forgery on his part. Any advice. This case is in Virginia. Thanks
