My soon to be ex-husband and I jointly own land in Virginia, (we are residents of North Carolina) and the property is to be mine as part of the divorce settlement. Our divorce has not been filed yet, but we have verbally agreed on all of the terms for a divorce and division of property. I have received an offer to purchase the Virginia land and I need to know that if my husband signs a quit claim deed, then am I free to contract to sell the land in just my name and receive the proceeds of the sell of the land in my name only without the divorce being final? There are no liens on the property.
