Separation Agreement


What is the name of your state? FL
Need to know if it would be a good idea to obtain a "separation aggreement" to protect myself as I hope to get my house paid off by my mother & buy out my wife among among other things before the divorce is final.
I copied & pasted the following " thanks in advance!
Does this mean if I have this form notorized & signed by both of us it would indeed be a cutoff?

"Cutoff date for valuation.
The cutoff date for determining assets and liabilities to be identified or classified as marital assets and liabilities is the earliest of the following: the date the parties enter into a valid separation agreement, another date established by the separation agreement, or the date of the filing of a petition for dissolution of marriage. "

A sep. agreement would be a good idea. You can state in it how all property, etc will be divided and anything else you feel will come up in the divorce. The cutoff date would be as of that date. To be safe, I'd file the agreement with the County Clerk, too. Probably shouldn't cost more than $10 to do that. Take two copies with you. In addition to that, you can also put an ad in your local newspaper stating that you are no longer responsible, as of a certain date, for any debts related to your wife.

Regardless of whether or not you and the soon-to-be ex draft a separation agreement, tell momma NOT to purchase the home until after the divorce is finalized and the property split is incorporated.

THEN, and only then, should she give you the money to buy out your ex.
