What is the name of your state (only U.S. law)? VA
I have a friend that is legally separated from his wife for a little over a year. With the economy the way it is, the wife lost her job and had no place to live. He allowed her to move back into the house into a spare bedroom. They have 2 daughters under the age of 18. Both receive their mail at the same address.
His question was since it's been over a year, will he be able to obtain his divorce now? Or does she have to move out, wait another year and then he can file for divorce?
