What is the name of your state? North Carolina

I would like to know what an individual would need to do if a court ordered separation agreement is violated. The divorce is final; however, the separation agreement was not incorporated into the divorce. Is the defendant still bound to follow through with the separation agreement since it is a separate and binding contract?

It is part of the judgment in the original lawsuit...or should be. Are you sure that in the judgment it doesn't incorporate the separation agreement by reference?

In any event, if you want the separation agreement enforced, go back to the court where the lawsuit was originally filed. (You need a lawyer.)
