What is the name of your state?New York
If me and my spouse haven't lived together for 2 years, does that make our seperation legal?

You are not legally separated until you file through the courts and a legal separation is is granted. You may be separated, but not legally separated.

If you can prove that you haven't lived together then that might be enough to prove separation for divorce purposes in NY. Consult a local attorney to be sure.
