Seperation questionWhat is the name of your state? Indiana My daughter has been seperated from her husband for close to 2 months. Her husband left her and their 3 small children to live with a so-called mutual friend (female). Since then My daughter has lost her job due to having to take care of their children alone, has no income, has been approved for utility assistance and food stamps and is struggling to make ends meet without losing her mind. I have watched the kids while her and my wife have went around putting applications in for new employment. I could go on about this sordid mess but my question is: My daughters husband said he DOES NOT have to pay child support or contribute anything to her household because they are still married. Is this correct? |

| I am answering because it looks like the ppl with more legal knowledge are all out having some fun today or pounding away at their jobs She can go down immediately to file for custody/visitation and support at the same time. I am not sure of the costs in your state, my state (NY) is free of charge in family court. My ex still had to pay to support his children, though we were still married. He has an obligation but may be a long process to get him to do so. I am assuming that since she has an open case for public assistance that they would have asked questions about custody, support, etc. My suggestions would be to get to family court immediately.
