Sex with your spouse and pending divorce

What is the name of your state (only U.S. law)? california

I've filed for divorce from my spouse of 5 months against thier wishes, can I have my divorce thrown out because we occassionally have sex?

You filed for divorce. If you want to have it thrown out, you don't need sex as an excuse. Just drop the divorce action.

Can your stbx have the divorce action thrown out? I'll leave it to someone more familiar with CA law. In some states and for some grounds for divorce, it can put the process on hold. I'd be surprised if it were an issue in CA, but we'll see what the real experts in CA say.
