My husband and I signed a purchase agreement for a house last October, with closing to be this February. We just recently separated, however. We have agreed to proceed with the buying process and buy the house (for our son), and my son and I will live there. My income is not sufficient to purchase the house on my own. Questions: 1. Is it necessary for my husband's name to be on the title if we are both on the mortgate? 2. How best to conclude the purchase and protect my interests being that we will soon be divorced?

The ONLY way this will be resolved is by both of you getting it resolved in the course of your lawsuit.

I would hope that you can get this settled amicably because if you don't you both will be involved in ANOTHER lawsuit and that one may be by the seller of this place.

I hope your divorce lawyer is also a good real estate attorney because you need one.
