Which State do I respond to.


What is the name of your state? Michigan

While living in Nevada last fall my wife left without notice and took our child. I had no idea of her whereabouts. She served me with divorce papers. In turn I filed a counter suit. This case is still pending, and open. Now months later I am served with Divorce papers from Texas. I am currently unable to get to Texas to respond to this new case. I have no idea which case takes precedence and the authorities in Texas will not or cannot respond to any question concerning how to get steered in the right direction. Likely I am unable to procure legal representation.

A point in the right direction would be greatly appreciated.

Without looking at all the documents, I would have to say that the first lawsuit filed governs.

I cannot understand why she filed two lawsuits.

What's going on?

Where was the original case filed? Unless your wife dismissed that case, which doesn't appear to be the case, then the original state would still have jurisdiction.

However, TX will proceed unless you officially ask them to dismiss the case due to the open case in the other state.

If the original case from Nevada has been dismissed I have not been informed of it. The problem is getting the Court in Texas to respond to calls . I'm not even sure the Texas Court is aware of the original suit. She went to Texas for financial assitance for her parents, and possibly, because of the way she left, to dodge what might be abandoment on her part . She just up and left with our child and didn't leave any forwarding address, or any clue as to her whereabouts. I had no idea where she was until the papers from Texas came.

Go to the courthouse in Nevada and get a complete copy of the file.

Also, get a clerk from the Texas court on the phone and ask how much a complete copy of the file will cost you. Get it.

Do NOT talk to the clerk about legal stuff; he/she will not care about your problems. Just request a copy of the file.
