My stbx and I came to an agreement in October and presented to the court in lieu of trial. I had already signed and he's out of state and agreed through his attorney.

As of today, he has not returned his signed copy. The Judge apparently faxed a memo to my attorney stating that if it's not in his office by Fri 12/16 then he is dismissing and we will have to refile the entire thing.

Can they do that? I signed my portion. So I'm to be punished and have to fork out more money to start the process all over again?

There is nothing at stake except a house and he already signed off on that. This is just plain lazy on his part. He has to go find a notary.

Double-check to see for sure if that is in fact what the memo says; it more than likely says the thing will be set for trial.
