My stbx and I are separating this week. I have not yet filed for divorce as I am saving for the lawyer fees. Can I legally take my kids to Ohio without the consent of thier mother. She knows I was going to move there when the divorce was final.

If there is no court order to the contrary, yes, you can legally take your kids out of state.

However, be prepared to come back to the home state for court hearings -- and be prepared for allegations that you kept the kids from seeing their other parent, unless you make herculean efforts to make sure visits do happen regularly.
