Texas Divorce Law-


My daughter's husband was in Iraq during this time she left Texas and moved up to Ohio to be with and around family. Now that he has returned from Iraq he advised her that he has initiated another relationship and wants a divorce. She agreed since they don't get along that well, he wanted to take the boys for the remainder of the school year and took them back to Texas. He was to bring them back after school was out, instead she has received no-contest divorce papers stating him as the primary caregiver and primary authority to designate who has the kids if he gets deployed again. She did not agree to give up her kids and will not sign the no-contest waiver from his lawyer. Can he keep the kids and not let her have them back? What parental rights does she have since she is up here in Ohio and he is in Texas?

She has parental rights, of course. She can have visitation and pay support.

When exactly, did she move to OH, and when exactly did the children go with dad to TX? Those dates are critical.
