Is there a subpoena to produce documents without the appearance of record custodian?


What is the name of your state? Colorado

Your post is confusing. Yes, you can subpoena (duces tecum) the records without the constodian being required to appear, but you would have to serve it on the custodian of the records.

There are at least 17 lawsuits (!!) filed in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.7M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Subpoena records without appearance of custodian


Is the subpoena refered to as a (Duces Tecum) if the custodian is not required to appear? Are other forms required as well such as affidavit of authenticity? Specifically I need a laywer but can't afford one. I need records to show expenditures and deposits from a Correctional Institution. It is 400 miles round-trip for a custodian of records although Colorado State may have a depot in Denver or Pueblo (I am in Colorado Springs). I just need to review collect calls, visit expenditures and cash sent to an inmate to calculate money due (formally), without an "approximately" statement in an affidavit. You are a Judgment Enforcement Specialist? I have a 10,000 judgment which is due to expire in February 2004. The party is in New York. You can have 60% of whatever you can collect. It is all there, just not in liquid assets. I contacted a New York agency some years ago; right after 9-11 and it just didn't get off the ground. Any suggestions?

Dear Sir: I do not know how to contact you off forum. Also I believe I have all the forms necessary, just needed to be certain they were correct and the verbage was specific, also that I include pertinent accompanying documents. I want to extend appreciation to you for your time, firstly, and secondly, would appreciate speaking or chatting with you regarding judgment recovery (I actually have two, DOW Corning and a private debt owed to me.)
