I have been married for nine years. No children and in New York. If we decide to divorce, my husband and I would sell our home. My question is if I leave the home during the process of divorce, is it possible that I won't get any money for the home when it is sold? Would that be considered abandonment? A friend told me that I should get a legal seperation first before I leave the home as the process for divorce is going so I won't lose out on money for my home when it's sold. I don't want to stay in the same house as him because my job is closer to my parents home and it would be easier for me to move out until the home is sold.

Also, I know I would be responsible for the mortgage if I left until it's sold. But am I also responsible for the utility bills as well?

Please help.

No, you moving out would NOT cause you to lose your share of the home equity. I don't know what people go around saying that kind of thing.:rolleyes:
