What is the name of your state? CA
I heard there was a 30 day time line on when a respondent has to file their response. Is this true?
Case in point. Husband filed for Legal Separation filed July 13, 2007. Husband served wife on 8-16-07. Husband said he would file papers, didn't. Wife picked up papers to file, heard about the 30 day filling period. There would be no changes to the documents. Just want to get them filed.
Do I have to refile a claim for divorce or file with the response papers?

You need to file a response to any papers served on you in a lawsuit.

If you are out of time, then file two things: the response and a motion to allow you to file out of time.
