What is the name of your state? TX

Two children were born prior to marriage; carries moms maiden name; dad's name not on birth certificate(s). Married Mar. 1997, another child born Nov. 1997, during marriage mom used maiden name on everything. Dad's name not on THAT birth certificate. Ready to file divorce and need to know if to file divorce with or without minor children? Does paternity need to be established in order to file divorce that includes minor children when the fathers name is not on the birth certificate(s)?

The short answer, no. If the petitioner alleges that the parties are the parents of the following children and their is no denial of paternity, then DNA tests are not required. If there is a denial of paternity, then the court will order paternity testing.
