HI,

Ex-husband fails to comply with support obligations for over a year. There is money in a trust account holding husband's half of the proceeds from the sale of the family home, plus a small amount of wife's proceeds. Reason for this is that there are payments that need to be reimbursed to wife for other community property that has either been sold, or has disappeared. Husband's attorney is trying to settle with wife for significantly less than she is entitled to, and without explanations as to where missing property is, and without any money toward support arrears. Husband promised to pay support out of proceeds of the house, in court before the Judge on numerous occasions.

There is the matter of one child, who is currently attending school in husband's town. Failure to comply with court ordered transportation schedule, on the father's part, has caused the arrangement to become hectic, and not in the best interest of the child. Father has abandoned his transportation obligations on numerous occasions, even to the point where the child has been left at school for over 45 minutes until mother could be reached to pick him up (mother lives 50 minutes away).

Husband wants to barter with the Wife on the child's school arrangement (switching to school in her district), for money out of the trust account. The child has repeatedly expressed his desire to attend school in Mother's town, but is only seven years of age. Father has also recently moved out of the school district where the child was previously attending.

Father is also on crank (no documented proof as of yet except for his constant refusals to submit to a hair follicle test in court). He has also recently been charged with domestic violence against his girlfriend, and the police report (which wife has a copy of) states that the domestic abuse has been going on for over seven months, but girlfriend has failed to report it due to his ongoing custody battle with ex-wife.

Here's the question:
Would it behoove the Wife to ask the Judge to decide on the school and money matters, or would she be better off to take the deal and be able to enroll her son in school locally.

The DA is involved now in trying to get the back support, but husband is self employed and has his money hidden, or in another name.

This battle has been going on for over a year. There is a lot more history, but I am trying to be as brief as possible. Thanks in advance for any reply.

The father's not going to be able to keep the kid enrolled in that school anyway as soon as they find out he lives out of district. Unless he doesn't mind paying out-of-district tuition (around 10k, usually).
