When is the best time to file for divorce in a financially speaking manner. I need to know in regards to wanting the child support to be based on this current year of earnings and not last year. Can you file January 1st and not have to file taxes together if your spouse hasn't been working and will recieve alimony?The state is MS.

As far as taxes are concerned, your marital status is your status as of 12/31.

If you are still married on 12/31, then you have to file married filing separately, or married filing jointly. If you have been separated for at least the last six months of the calendar year, then its possible that you could be single for tax purposes.
