When would a Divorce case be considered abandoned due to inactivity in the case? (I am helping the Respondant) The case was first filed Nov 27 2007., Child support was heard first, then custody was decided with the custody order being put into place in Dec 2008. Since then the only thing that has happented were contempt filings by respondant that were heard shortly thereafter. The court has no interloctary judgement in place and she has done nothing since other than try to get Respondant to sign the final divorce papers out of court, however he will not do so until property settlement is done (there are not even temporary property orders, ONLY child support, then custody). We were told by a former Paralegal that this should be possible but she has been out of the system for awhile, so can he file now, or does it need to be longer?
