Question

who to contact? what is the next step?


What is the name of your state? Living in California, Ex-wife in New York

I would like to get advice what would be the next logical step or how to deal with this issue.

I have been divorced for 7 years now and I don't have any contact to my ex-wife who lives in new york. We purchaced a house together and the title is on our both names. After separation and divorce, I only picked up few personal items and left the state and left my ex living at our house. Now, it has come to my attention, that she has been late in the mortage payments which has effected my credit rating. How would I go about selling or refinancing the house, so that I will get my share of the house and out of the mortage?What is the name of your state?

What did your property settlement say about the house...exactly?

There is no property settlement. I moved to CA and left everything to start over.

If you are divorced there is a property settlement. It may state that she gives you the house without requiring her to release you from the mortgage, but it says SOMETHING. It may even be a default judgement if you didn't contest anything.

What you are able to do depends on what the divorce paperwork says. So, if you don't have a copy, you better contact the courthouse where the divorce was finalized and get a copy. Once you get that, then consult an attorney.
