What is the name of your state (only U.S. law)? Delaware

In a divorce who owns naked/sex photos and porn videos of the couple? We have tons of sex video and pornographics videos of ourselves.

What are the legal guidelines in Delaware with regarads to this? Can this be used in settlement negotiation? Are they split, traded, or does each person own half? How does this work?

Legally, you both have equal rights, at least to the ones that you are both in. Arguably, the ones that only one of you is in should belong to that person. You really have 2 choices:

1. Reach an agreement between yourselves. This is by far the easiest and least expensive approach.

2. Ask the court to decide for you. This will be expensive and time consuming. The court could do any number of things. They might have you split them. They might say that the ones that you are in belong to you, the ones she is in belongs to her, and you split the rest. Or they might refuse to decide and let whoever is holding them at the time keep them.

I should also say...i would NEVER release them or use them against her or threaten her with them in anyway. Can I legally keep them? If she told her lawyer I had them and was keeping them could I get in trouble? Could I inform her that I have them and wanted to keep them? Or would they try to get them in a settlement? What does the law say in delaware?

Why in the world would you want to keep pornographic videos or pictures of a wife you are divorcing?...particularly ones of said wife with other men?

Based on the bolded did you take them without her knowledge?

have you stepped outside your door this century LdiJ? This really does not sound all that odd compared to a lot of other things I have heard about. Not that I disagree with you but I think we are part of an older generation.

Heck, I remember knowing a woman that wouldn't even undress in front of her husband ...


and no, it is not part of that old joke where the guy insisted the lights were off every time he and the wife had sex. When she turned them on one time she realized he was using an "appliance" on her in place of his own "tool". She looks at him and says "how could you? Explain yourself". He says "well, I'm impotent and always have been and I could never bring myself to tell you but now I want you to explain our 3 children!!!!":eek:

No judge on the planet is going to want to deal with this. So here's your practical solution: either they all get destroyed, or you duplicate the whole she-bang (pun intended) and each party gets a copy of the whole set.

After reading the recent posts, another option occurred to me. You can send the entire collection to say, Ohiogal, who can hold it in escrow (and/or review the performances).
