My brother and his wife are getting a divorce. She recently took his debit card and withdrew several hundered dollars of from an account bearing only his name (yes, he was stupid and forgot to change the PIN). Can he press charges against her for this?

ARG...no, he cannot "press charges"...he gave her the pin number therefore he authorized her to access the account. However he can make the money that she removed part of the overall property settlement.

If he is wise he will cancel that account and open another.
