dealing with ohio child services

What is the name of your state (only U.S. law)? ohio

i am accuse of inappropriate touching a step daughter.no criminal charges and im not worried about that part of this case.nothing happened,so im confident no criminal charges will be brought up.my problem is i know nothing about child services,never had to deal with them ever.i know you have the right to remain silent,ect.but it is so much different when they threaten to take my kids out of the house if you dont do certain things.like something as simple ass answering questions you know has nothing to do with the alogations,ect.i was also had to leave the house until further investigation,under threat of removing the kids.that is the worst for me,even if for couple days.so i sign and agreement to leave and not contact the kids,even on the phone.now idk what to do.small town,cant get in to talk to a lawyer very quick,cant afford a high retainer.dont think they give public defendents for dealing with child services.feel reall insecure dealing with them with out knowing the rights of everybody in the house.not just for me but for them and there mother.

will a lawyer be any help?or am i at the mercy of what ever hoops child services has me jump through?

they said it could be couple days to couple weeks to decide if i can conctact m kids or go back home with them there.i can go there if they go somplace else while im there ect.just doesnt seem right.like im guilty until they proove im inocent.again ill say im not worried about the criminal side of this.im just worried about m children,i know they already ask where i am but i dont want to do anything to risk them going to foster care,even over night.
Without a court order CPS can DO NOTHING. A lawyer can be a big help. Don't deal with them. Don't talk with them. I am appointed counsel for CPS cases in Ohio. Don't say ANYTHING to them. Neither should the other parent of the children. Both of you should tell them to take a short walk off a long pier. They have no legal authority to do anything. What they can do is go to court and request that. Then, as soon as they do that, YOU request court appointed counsel. What county?

Please PLEASE listen to OG on this one because CPS WILL say everything she is telling you is WRONG! They WILL say they have legal authority to do whatever they like and they'll use the guise of "best interest of the children" to do it. They are NOT your friends and they will NOT play nice if you assert your legal rights. If you know you aren't guilty then don't be afraid to tell them to find a sandy beach and begin pounding until a court tells them otherwise.

If they tried they need a court order or the police to show up and say the children are at risk of immediate harm. Then you need a hearing the next business (court) day. DO NOT LISTEN TO CPS. Let me see what I can find about Auglaize county -- which is the boonies.

CPS can kiss my butt. And yes I have told them that in Ohio. I have been asked if they would be welcome in my house and I have told them the honest answer to that -- which I cannot say on here. they know if they show up without a court order, I will exercise castle doctrine to escort them to the street.

ETA: My children have also been told since they could speak that CSB is evil and prosecutors suck.

The downside of indoctrinating a child is that they can become so desperately afraid of saying the wrong thing to the wrong person that they may just go ahead and allow abuse to continue even as adults.

Why in the blazes would you be offended? I'm not implying anything. I'm saying very clearly that teaching an absolute can have devastating consequences.

CSB workers are like any other group of people. Mostly average with some stellar examples and some abysmal examples. The only difference is that when this particular tree of abysmal collapses, the residents of that tree tend to hit every branch on the way down and takes out 20 other trees in the process. It leaves everyone with something of a dislike of trees even when the other trees are just being trees.

There has to be a middle ground. Some teachers are completely crap at what they do - but it doesn't mean that every teacher is crap. A brain surgeon who nicks the cerebral artery by accident doesn't represent every brain surgeon. Same with CSB and/or prosecutors.

If you want to take it personally, that's fine. Your prerogative. Given that you're neither a prosecutor nor a CSB worker, I'm still not entirely sure what you're disagreeing with.
