PC242, and other than the battery aspect, doesn't it concern you in the least that someone who is NOT the child's parent is spanking them?
Parents are allowed to give permission for others to spank their child.

A parent, guardian, or other with the parent's permission can inflict lawful corporal punishment without fear of criminal charges. PC 242 is not going to be an issue here. Whether it is a good idea for the noncustodial parent to inflict a spanking is a different topic from whether or not it is legal.
