What is the name of your state?
Illinois
My daughter recently left this state with her 2 children after being abused by her husband. He refuses to support the children and calls constantly. She would like a seperation but the state she is in says she has to wait 60 days. She is scared to come back. The children want to come home but do not want to live with their father. Is there a way to get a legal seperation and file before returning to this state. Or does she have to wait the 60 days.

She screwed up by moving to another state. She should have stayed in the state she was in and filed. She can't forum shop. Nor can she decide to file in the state she left because she no longer lives there. Oh and the children will most likely be with dad part of the time and mom cant' stop that.

And dad can file in his state for custody and have the children IMMEDIATELY returned to him. Then mom doesn't have to worry about filing.
