Getting a restraining order on someone who has a restraining order on you?


What is the name of your state (only U.S. law)? Florida

Can I file for a restraining order on someone who already has a restraining order on me? I know it sounds a bit awkward and cludgey but there is plenty of evidence and legitimate reasoning.

You might need to explain the circumstances though - theoretically the two of you shouldn't even be in touch....

Yes, you can try. But you're going to need some VERY strong evidence before you will have even the slightest chance of prevailing. In addition to that, it could easily lead to charges against you for trying to circumvent the existing order by selling your gun to your brother that you live with part of the time:

In addition that, your mother is also filing for an order.

When a Judge sees all of that, it's very likely that it will appear that you and your mother are the guilty parties.

Mother has one in place now already, so I'm not sure how the court will take that into consideration.

And I'm not so sure it could lead to issues with guns, as I no longer own any. I don't think it could "easily lead to charges" as Gracie3787 stated, I didn't circumvent anything, I sold the gun. There were no written restrictions on who I could sell it to, and for me family ALWAYS comes first.

Anyway he was able to get a restraining order on me with a few simple lies in a case of his-word-against-mine so I'm HOPING it will be quite simple for me given I actually have legitimate evidence and a need for a protection order.
