I'm going to summarize this as best I can.


Husband was verbally/emotionally abusive for the 6yrs we were together. It started getting more violent with the threats he made. He almost hit me. He put his fist up to my face and tapped my nose saying " Just you try it" after I threatened to call the cops. I used my iphone to voice record several instances of him yelling at me. "I want to take your head and pound it into the wall." , "I'm going to rip your f*cking head off and Sh** down your neck if you don't shut the SH** up." I said I'd call the cops if a man ever hit me. And he said " Just F***ing try it"..Saying how a friend of mine who has an abusive husband must be a smart guy and maybe he should start acting like that too. And how if " Behave like a F***ing child I will put my hands around your neck like a F***ing child and lead you around". Continues to say how if my behavior does not change he will leave me, how he's wanted to leave me in the past...makes fun of my physical appearance, calls me retarded...and that he would have left me years ago if it had not been for our child. And how the only reason I am there is because of our child. And that nobody else would want me. And that I'm lucky to have him. I have filed for adultery, cruelty and "something" desertion meaning he mentally/emotionally left the relationship yrs ago.

I recorded this on my iphone. I burned it to CD. Can this be used in court? I have both my and his voice on it as its a two way conversation. He calls me by my name.What is the name of your state (only U.S. law)?

What do you mean by credibility and other issues? Could you be more detailed?

In the recording he makes threats. I left due to some of these threats on the advice from our relationship councler when I called and told her what happened. She said she would speak in court on my behalf if needed. So I guess in a way she knows what was said because I spoke to her after it happened. Which would confirm what was on the recording. Could that help it be used as valid evidence?
