| | Personal Property I moved from Washington State to Chicago Illinois to live with my boyfriend. After 8 months and physical abuse I moved back to Washington. All of my belongings, aside from a few suitcases of my clothes and shoes, are still at his house. He is threatening to throw it out and give what he can to the goodwill. I haven't abandoned it, there was no lease signed by me or any other kind of contract. I just had to leave due to the physical abuse.... My question is can he legally dispose of my things?
What are my rights?
What is the name of your state (only U.S. law)? WA. |

I left on March 24th.
I had to get a ticket back to WA. asap. 2 days previous to me leaving, he drug me through the house and proceeded to get physical with me. The police were called and they made him leave. He came back to the house and I had to call the police again. They came back searched the house, he had left before they got there, they looked at me and saw all of the marks on my body from what he did and asked me to press charges. I didnt but they had me sign a paper so that it was on record.
It was an unplanned emergency decision to move back home. I want my things back but I need to have money to do that. Which Im presently saving. Its not like I am leaving my things there forever, I just need time to get enough together to ship it all back.
I lived there for 8 months. I received my mail there.
He's threatening to throw it all out and donate it to goodwill. |

LEGALLY you abandoned your property. If you had followed through with the criminal case you would not be in this position.

He's threatening to throw it all out and donate it to goodwill. | 60 DAYS??? No court is going to require him to keep your things any longer than that. Not without a written agreement between the two of you or unless you are PAYING him for storage and he is accepting the monies... | |
