Posting a video without consent

What is the name of your state (only U.S. law)? Minnesota

I have a no contact order against my ex, he recently broke some expensive property of mine and I know I could at least report him for breaking the no contact order. Unfortunately he has an explicit video of me (yes it was consensual at the time-he assured me he'd delete it soon after but now refuses to) and he's threatening to put it online if I go to the police. My understanding is there's no real way to stop or prosecute this? Is there anything I can do legally in this situation?

If you report him to the police not only for breaking the no contact order, but also for the destruction of your property AND the threat to post that video online, that should go a long way towards resolving the problem.

I'm just concerned he'll find a way to post it anyway and there'll be no way to "prove" he did it...

Not much you can do about that one way or another. Computer files can easily get "lost" and later "found" by some unscrupulous party that posts them online. Once you transmitted your personal video to someone else, you lost all (physical) control over its distribution.

You may still have some legal control, but that isn't always effective (in fact, it rarely is). The lesson here is to keep your private videos private in the future.

Your remedy against him may be both criminal and civil, but even those stiff penalties might not stop him.

I am also going to say that based on what you said here, combined with your comments on another thread make me feel that you really need to find your backbone. If you do not stand up for yourself by reporting him, you are basically giving him a license to continue to abuse you.

If you're going to film yourself in the act of having sex, don't complain if down the road an uninvited person ends up viewing it. That said, is it on one of the various free porn sites for viewing?

single317dad, thanks for your response, that's basically what I suspected.. it's definitely a risk.

LdiJ, I do want to report him but I'm thinking the best option is probably to just cut my losses and try to move on.. The scary thing is I know he could do this to someone else in the future, but I think it would take more than another stint in jail to change that.

Silverplum, thanks for the link. Excellent suggestion about contacting the state legislator, maybe that's one positive thing that could come out of all this. I actually considered going to law school at one point so it might be kind of exciting to get involved in something like that.

davew128, lol not that I know of. I've been going through a bit of a rough time lately, living on the edge and drowning my sorrows in occasionally excessive amounts of alcohol... Not my finest moment but it happened, you live and you learn right.
